Sometimes simply writing a letter before action can lead to prompt payment. But if this doesn’t produce a good result our team is ready to enact the next steps in pursuing payment

The main stages of debt recovery are:

  1. Letter before action to the debtor – This typically takes 14 days however some debt recovery matter needs further consideration and evidence obtaining before a comprehensive LBA can be produced. You will be advised if the debt needs further consideration.

  2.  Issuing the claim - It is estimated that this stage will typically last 21 days from the date the Claim issued. However, this is subject to the time it takes the Court to issue and serve the Claim Form and the response from the debtor, if any. The Claim Form will be prepared by us and sent to the Court on the same day you give us instructions to start Court Action.

  3. Enforcement – As every case is different and enforcement prospects, we are unable to give an accurate timescale for this process.


Costs

The cost of debt recovery matters depends on whether the matter is disputed or not and the necessary steps that will need to be taken.

To initiate the process which includes:

  1. taking instructions

  2. calculating interest due

  3. preparing a Letter Before Action

  4. initial communications between the respective parties

Usually it costs around £600 plus VAT, this sum is subject to change depending on the next action we will need to take. If you need an inexpensive option, please speak with us.

The next steps could include issuing Court proceedings which could mean that you would pay disbursements such as a Court fee & Hearing fees which vary depending on the total sum of monies you are owed. Please see the below table for Court Fee costs:

More than £500 but no more than £1,000: £70

More than £1,000 but no more than £1,500: £80

More than £1,500 but no more than £3,000: £115

More than £3,000 but no more than £5,000: £205

More than £5,000 but no more than £10,000: £455

More than £10,000 but no more than £200,000: 5% of the value of the claim

More than £200,000: £10,000

Please be aware that Court fees do not attract VAT, however, there may be disbursements which we will discuss with you in depth that could attract VAT at the rate of 20%.

Our current rates range from £134 per hour (excluding VAT) for our legal assistants to £272 per hour (excluding VAT) for our most experienced solicitors.

We do offer No Win, No Fee Agreements, we are happy to discuss whether we can take on your matter under such agreement, however, we must advise that you would have to pay for disbursements such as those stated above.
